The agreement that governs your use of Radar Camera.

This End User License Agreement is the agreement between you and Theodore Tomita III, doing business as Tomita Tech, for the Radar Camera app for iPhone. It replaces Apple's Standard End User License Agreement. Downloading, installing, or using Radar Camera means you accept it. If you do not accept it, delete the app.
Radar Camera has no accounts and no servers, and it sends nothing anywhere. There is no service running behind it, so this agreement covers the software on your phone rather than any service we operate.
Apple is not a party to this agreement. Apple did not make Radar Camera and is not responsible for it. Apple is a third party beneficiary of this agreement and may enforce it against you, as described below.
How the app handles information is set out in the Radar Camera Privacy Policy.
We grant you a personal, limited, non-exclusive, non-transferable license to use Radar Camera on any Apple branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing and volume purchasing give access to others exactly as those Apple programs describe, and no further.
This license does not let you use Radar Camera on Apple branded products that you do not own or control, and it does not let you make the app available over a network where more than one device could run it at once. We keep every right we have not expressly granted here.
Radar Camera never receives, uploads, or looks at what you capture. You own everything you record with it, and we claim no rights or license to any of it.
You are responsible for what you record. Recording people, and recording sound in particular, is regulated differently from place to place. Getting whatever consent the law where you are requires, and following local rules about photography and recording, is on you, not on us.
Radar Camera is sold through the App Store. Apple takes the payment, sets how purchases and family sharing work, and handles refunds under the Apple Media Services Terms and Conditions. We cannot issue a refund ourselves. Refund requests go to Apple, through reportaproblem.apple.com.
The app contains no in-app purchases and no subscriptions. We may change the price for future buyers, and a price change gives you no claim to a refund of what you already paid.
Radar Camera runs on iPhone, on iOS 26 or later, in portrait orientation. What the app can do depends on the hardware in your phone. Dual Lens recording needs an iPhone with two or three rear cameras; on a single camera iPhone, one camera feeds both outputs. The app hides modes your hardware cannot run rather than offering them and failing.
We make no promise that the app runs, or keeps running, on hardware or operating system versions outside that range, including on beta releases of iOS.
We are solely responsible for any maintenance and support for Radar Camera. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
Support requests go to [email protected]. We answer what we can. We may release updates that add, change, or remove features, and we are not obliged to keep releasing them, or to keep supporting older versions of iOS, forever.
Radar Camera is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.
Recording video is subject to the limits of the hardware and of iOS. A take can be cut short by an incoming call, low storage, a thermal limit, another app claiming the camera, or a system interruption, and the app cannot always prevent that. We do not warrant that any particular take will record or save successfully. Keep your own backup of anything that matters to you.
Where the law gives you a warranty that cannot be disclaimed, we, not Apple, are responsible for it. If Radar Camera fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to Radar Camera, and any other claims, losses, liabilities, damages, costs, or expenses that are attributable to a failure to conform to any warranty are our sole responsibility.
We, not Apple, are responsible for addressing any claim from you or a third party relating to Radar Camera or your possession and use of it. That includes product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar law.
Radar Camera, its name, its icon, its design, and its code belong to us and are protected by copyright and other laws. This agreement is a license, not a sale, and nothing in it transfers ownership to you.
If a third party claims that Radar Camera or your possession and use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost recordings, arising out of or relating to Radar Camera, even if we have been told such damages are possible. Our total liability for any claim relating to the app is limited to the amount you paid for it.
Some jurisdictions do not allow these exclusions or limits. Where that is the case, they apply to you only as far as the law allows, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
By using Radar Camera you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that the U.S. Government has designated as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable U.S. and other export control and sanctions laws.
Radar Camera uses only encryption provided by the operating system and standard, exempt cryptography. It includes no proprietary encryption.
You must comply with any applicable third party terms of agreement when you use Radar Camera, including the Apple Media Services Terms and Conditions and the terms of your mobile carrier or data plan.
Apple, and Apple's subsidiaries, are third party beneficiaries of this agreement. When you accept it, Apple has the right, and is deemed to have accepted the right, to enforce this agreement against you as a third party beneficiary of it.
You must be at least 13 years old to use Radar Camera. If you are under 18, you may use it only with the involvement of a parent or guardian who accepts this agreement on your behalf. Purchases made by a minor are governed by Apple's terms and by whatever family controls the account holder has set.
This agreement applies until it ends. Your license ends automatically, without notice from us, if you break any of its terms, and you must then stop using Radar Camera and delete it. You can end this agreement at any time by deleting the app. The sections that by their nature should outlast it, including the warranty disclaimer, the limitation of liability, the intellectual property terms, and governing law, survive.
We may update this agreement as the app changes. The new version goes on this page with a new date at the top, and a significant change will be called out with the release it accompanies. Continuing to use Radar Camera after an update means you accept the updated agreement. If you do not, stop using the app and delete it.
This agreement, together with the Radar Camera Privacy Policy, is the whole agreement between you and us about the app, and it replaces anything said about it beforehand. If a court finds part of it unenforceable, the rest stays in force. Not enforcing a term once does not waive it. You may not transfer your rights under this agreement; we may transfer ours in connection with a sale or transfer of the app, on terms that keep your rights intact.
This agreement is governed by the laws of the State of New York and the applicable laws of the United States, without regard to conflict of law rules. Any dispute relating to this agreement or to Radar Camera will be handled exclusively in the state or federal courts located in New York, and you agree to the jurisdiction of those courts. If you live somewhere whose consumer law gives you rights this section cannot take away, those rights still stand.
