The agreement that governs your use of Radar Route.
Last updated: September 23, 2026
This End User License Agreement is the agreement between you and Theodore Tomita III, doing business as Tomita Tech, for the Radar Route app for iPhone. It applies where it is provided as the app's custom license agreement through the App Store. Downloading, installing, or using Radar Route means you accept it. If you do not accept it, delete the app.
Radar Route is route planning software. It stores plans and outings on your iPhone, uses Apple Maps services for search and driving estimates, and can open Apple Maps for navigation. It has no Tomita Tech account system or route server. Optional plan sharing sends a file through a service you choose.
Apple is not a party to this agreement. We, not Apple, are solely responsible for Radar Route and its content. Apple is a third party beneficiary of this agreement and may enforce it against you, as described below.
How the app handles information is set out in the Radar Route Privacy Policy.
We grant you a limited, non-exclusive, non-transferable license to use Radar Route for personal or internal business purposes on any Apple branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing and volume purchasing give access to others exactly as those Apple programs describe, and no further.
These restrictions do not limit access expressly permitted by Apple's Family Sharing or volume purchasing programs. This agreement does not override the Apple Media Services Usage Rules that apply when you obtain the app. We keep every right we have not expressly granted here.
You retain any rights you have in the names, notes, and other content you enter. Tomita Tech claims no ownership of that content. Apple and its licensors retain their rights in maps, place information, and other content supplied by their services.
You are responsible for the information you add, import, or share, including other people's names and addresses. Share only content you have permission or another lawful basis to disclose. Review a plan before sharing it. Notes are included by default unless you turn Include Stop Notes off.
Anyone with a shared plan file can read its included information. Recipients control their own copies, and deleting your plan does not delete theirs. Imported plans come from their sender; review destinations and requirements before relying on them. Tomita Tech does not host or retain a copy of your plans for recovery.
Radar Route is distributed through the App Store. Any purchase price is shown there before you confirm a purchase. Apple handles App Store payments and refund requests under the applicable Apple Media Services Terms and Conditions. You can request a refund through reportaproblem.apple.com.
The current app contains no in-app purchases or subscriptions. We may change the price for future purchases. This section does not limit any refund or other consumer right that applicable law gives you.
Radar Route runs on iPhone with iOS 26 or later. Place search, current place details, maps, and driving estimates require access to Apple's services and a network connection. Availability and coverage can vary by region. A saved plan does not guarantee that mapping or navigation will work offline. Data charges may apply.
Location and Contacts permissions are optional. You can choose starting addresses without location access and find destinations without Contacts. Automatic arrival needs location access with Precise Location enabled. During a leg you start, location updates may continue in the background while Apple Maps is open.
Operating system restrictions, connectivity, battery state, and location accuracy can affect the app. We do not promise support for every future device or operating system version, including beta releases.
Radar Route provides planning assistance. Stop order, travel times, distances, arrival estimates, road details, and automatic arrival detection can be incomplete or inaccurate. Traffic, road access, closures, opening hours, and conditions can change. A calculated order is not a guarantee of the fastest route or of arriving within a requested time.
Apple Maps handles turn-by-turn navigation and may choose a different route or apply its own preferences. An avoid-highways or avoid-tolls preference does not guarantee that those roads will be excluded.
Check destinations, entrances, access restrictions, and timing before you travel. Follow traffic laws, posted signs, and actual conditions. Stop safely before entering information or changing a plan. Do not use the app in a way that distracts you while driving, or rely on it for emergency response or other uses where an inaccurate estimate could endanger someone.
We are solely responsible for any maintenance and support for Radar Route. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
Support requests go to support.tomitatech.com. We provide support and maintenance as required by applicable law. We may release updates that add, change, or remove features. Subject to your statutory rights, we do not promise indefinite updates or support for older operating system versions.
Radar Route is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that a route, travel estimate, place result, arrival detection, import, or save operation will always be accurate, available, or successful. Keep a separate record of essential destinations and arrangements, and use the backup options appropriate for your device. Apple service interruptions or changes can affect features that depend on those services.
Where the law gives you a warranty that cannot be disclaimed, we, not Apple, are responsible for it. If Radar Route fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to Radar Route, and any other claims, losses, liabilities, damages, costs, or expenses that are attributable to a failure to conform to any warranty are our sole responsibility.
We, not Apple, are responsible for addressing any claim from you or a third party relating to Radar Route or your possession and use of it. That includes product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar law.
Radar Route, its name, its icon, its design, and its code belong to us and are protected by copyright and other laws. This agreement is a license, not a sale, and nothing in it transfers ownership to you.
If a third party claims that Radar Route or your possession and use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or missed visits, arising out of or relating to Radar Route, even if we have been told such damages are possible. Our total liability for any claim relating to the app is limited to the amount you paid for it.
Some jurisdictions do not allow these exclusions or limits. Where that is the case, they apply to you only as far as the law allows, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
By using Radar Route you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that the U.S. Government has designated as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable U.S. and other export control and sanctions laws.
You must comply with applicable third party terms when using Radar Route, including the Apple Media Services Terms and Conditions, the terms applicable to Apple Maps, and your mobile carrier or data plan. Apple Maps content remains subject to Apple's and its licensors' rights and restrictions.
When you share or save a plan through another app or storage provider, that provider's terms apply to its handling of the file. We do not control those services or promise their continued availability. Their independent handling of information is described in the Radar Route Privacy Policy.
Apple, and Apple's subsidiaries, are third party beneficiaries of this agreement. When you accept it, Apple has the right, and is deemed to have accepted the right, to enforce this agreement against you as a third party beneficiary of it.
You must have the legal capacity to accept this agreement where you live, or have a parent or legal guardian review and accept it on your behalf where permitted by law. Purchases made by a minor are governed by Apple's terms and by the family controls the account holder has set. Permission to use this app does not authorize anyone to drive without meeting local licensing and other legal requirements.
This agreement applies until it ends. Your license ends automatically, without notice from us, if you break any of its terms, and you must then stop using Radar Route and delete it. You can end this agreement at any time by deleting the app. The sections that by their nature should outlast it, including the warranty disclaimer, the limitation of liability, the intellectual property terms, and governing law, survive.
We may update this agreement as the app changes. The new version goes on this page with a new date at the top, and a significant change will be called out with the release it accompanies. We will provide any notice or obtain any consent required by applicable law. Updated terms apply prospectively and do not remove rights that applicable law gives you. If you do not accept the terms applicable to an updated version, do not install or use that version.
This agreement, together with the Radar Route Privacy Policy, is the whole agreement between you and us about the app, and it replaces anything said about it beforehand. If a court finds part of it unenforceable, the rest stays in force. Not enforcing a term once does not waive it. You may not transfer your rights under this agreement; we may transfer ours in connection with a sale or transfer of the app, on terms that keep your rights intact.
This agreement is governed by the laws of the State of New York and the applicable laws of the United States, without regard to conflict of law rules. Any dispute relating to this agreement or to Radar Route will be handled exclusively in the state or federal courts located in New York, and you agree to the jurisdiction of those courts. If you live somewhere whose consumer law gives you rights this section cannot take away, those rights still stand.
Questions, complaints, or claims about Radar Route go to [email protected] or 845-443-0803.
